In short
- Eleven2Go is a club management app. Your club (the organisation you joined) decides what goes into it and who sees it; we provide the platform.
- You must be 18 or over to hold your own account unless a guardian set it up or supervises it. Guardians are responsible for the players they act for.
- Keep your login safe, be respectful, and only upload content you have the right to share.
- Some features may use AI. It can be wrong, so check it before relying on it.
- We work hard to keep the service running, but we provide it "as is" to the extent the law allows. Nothing here limits your rights under the Australian Consumer Law.
- These terms are governed by the law of New South Wales, Australia.
1. About these terms
These Terms of Use ("Terms") form an agreement between you and Eleven2Go ("Eleven2Go", "we", "us" or "our"), an Australian-based provider of club management software. They apply to the Eleven2Go apps for iOS, Android and the web, this website and any related services (together, the "Service").
Our Privacy Policy explains how we handle personal information and forms part of these Terms for that purpose.
2. Acceptance
By creating an account, signing in, accepting an invitation or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Eligibility, players and guardians
- You must be at least 18 years old to create and hold an account in your own right.
- A person under 18 may be represented in the Service by a guardian. A guardian is a parent, legal guardian or other adult with legal authority to act for that player, or who is authorised to do so by the player's club.
- If you are a guardian, you confirm that you have the authority to act for each player you link to your account, that the information you give about them is accurate, and that you consent on their behalf to their participation in the Service and to the handling of their information as described in these Terms and the Privacy Policy.
- Guardians are responsible for supervising how players in their care use the Service, and for any actions taken on a player's behalf.
- Where a young person is given access to the Service, that is a decision for their guardian and their club. We may ask for evidence of guardianship or authority and may remove a link if we are not satisfied that it is genuine.
- We may refuse or end access where we reasonably believe these requirements are not met.
4. Accounts and security
- Accounts are global. One account (identified by your email address) can be linked to more than one organisation, and to more than one player. The information each organisation holds about you or a player is kept separately for that organisation.
- You must give accurate information and keep it up to date.
- You are responsible for keeping your password and devices secure, and for all activity under your account. Do not share your login. Tell us promptly at support@eleven2go.com if you think your account has been accessed without your permission.
- To help with support and to investigate problems, authorised Eleven2Go staff may view the Service as a user would, in a way that is logged and limited to what is needed for that purpose.
5. The role of organisations
- The Service is used by clubs and other organisations ("Organisations"). Each Organisation decides who it invites, what roles and permissions people have, what information it records and what it posts.
- Organisations are responsible for their own content, their members and staff, their decisions, and their compliance with the laws that apply to them, including privacy, child safety and working-with-children requirements. This includes obtaining any consents they need from players and guardians.
- For personal information that an Organisation puts into the Service, the Organisation is the party that decides why and how it is used, and Eleven2Go acts as its service provider, handling that information on the Organisation's instructions and as described in our Privacy Policy.
- Eleven2Go is not a party to the relationship between an Organisation and its members. We are not responsible for an Organisation's fixtures, training, selection, fees, safety arrangements, communications or other activities, and disputes with an Organisation are between you and that Organisation.
- An Organisation's administrators can see, change and remove information about its members in the Service, and can remove a person from the Organisation. If you leave or are removed, the Organisation may keep the records it is entitled or required to keep.
6. Acceptable use
You must not, and must not help anyone to:
- break any law, or infringe the rights of others, including privacy, intellectual property and confidentiality rights;
- harass, bully, abuse, threaten, discriminate against or defame any person, or post anything that is obscene, sexually explicit, hateful or that exploits or endangers a child;
- impersonate another person, or claim authority (such as guardianship) that you do not have;
- upload malware, or interfere with or disrupt the Service, its security or its infrastructure;
- probe, scan or test the vulnerability of the Service, or bypass any access control, rate limit or permission;
- access data belonging to another account or Organisation without authority;
- scrape, harvest or bulk-copy data from the Service, or use automated means to access it, except through interfaces we make available;
- send spam or unsolicited commercial messages through the Service;
- reverse engineer, decompile or copy the Service, except to the extent the law allows; or
- use the Service to build a competing product, or resell access without our written agreement.
We may remove content and act on accounts that we reasonably believe breach this section.
7. Your content and photos
- "Your Content" means anything you or a person you act for submit to the Service, such as names, profile photos, images, messages, notes, responses to events and other information.
- You keep ownership of Your Content. You give Eleven2Go a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, display, transmit and otherwise use Your Content as needed to operate, secure, support and improve the Service and to provide it to you and to the Organisations you are linked to. This licence continues for as long as Your Content is in the Service and for a reasonable period afterwards while it remains in backups.
- You confirm that you have the right to submit Your Content and to grant this licence, and that it does not break these Terms or any law. For a photo of another person, this means you have that person's consent or, for a minor, the consent of their guardian.
- Images may be publicly accessible. Profile photos and other images you upload are stored on public image hosting so that they can load quickly in the apps. Anyone who has the exact address of an image may be able to view it without signing in, even though addresses are not published or listed. Do not upload an image you would not be comfortable with being viewed this way.
- The Organisations you are linked to, and their authorised staff, can see Your Content that is relevant to that Organisation, in line with the permissions they have set.
- We do not check Your Content before it is published, but we may review it, remove it or restrict access to it if we reasonably believe it breaches these Terms or the law, or on a valid complaint.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, trade marks and other material (other than Your Content and Organisations' content), is owned by Eleven2Go or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose in accordance with these Terms. All other rights are reserved.
If you give us feedback or suggestions, you agree that we may use them without restriction or payment.
9. AI features
- Eleven2Go may offer features that use artificial intelligence or other automated tools, for example to suggest, draft, summarise, translate or organise content ("AI Features"). Some AI Features may be labelled as beta.
- AI Features may produce output that is inaccurate, incomplete, out of date or unsuitable. Output is provided for convenience only and is not professional, medical, legal or safety advice. You and your Organisation are responsible for reviewing output before you rely on it, publish it or act on it, and for what you choose to do with it.
- To provide an AI Feature, we may process the content you or your Organisation choose to use with it, including personal information in that content, and we may use trusted service providers to do so, which may be located outside Australia. Do not put information into an AI Feature that you are not authorised to share.
- We do not use Your Content or an Organisation's content to train general-purpose AI models, and we do not allow our AI service providers to do so, unless you or the Organisation have given consent. We may use de-identified and aggregated information about how features are used to operate and improve the Service.
- We may change, limit or withdraw any AI Feature at any time.
10. Third-party services
The Service relies on third-party providers, for example for hosting, sign-in, email delivery, push notifications and app stores. Some of those providers apply their own terms and privacy practices. We are not responsible for services we do not control, including your mobile network, device, operating system, app store or internet connection. The Service may link to third-party websites, which we do not endorse or control.
11. Notifications and communications
- By using the Service you agree that we and your Organisations may send you service messages by push notification, email and in the app, for example about events, schedules, responses, invitations, reminders, changes, security and account matters.
- You can control many notification settings in the app, and you can switch off push notifications in your device settings. Some messages, such as security messages and notices about these Terms, are essential and cannot be turned off while you have an account.
- If you are a guardian, you agree that messages about a player may be sent to you.
- We will only send you marketing about Eleven2Go where the law allows, and you can opt out at any time using the unsubscribe link or by contacting us. Organisations' messages are sent by them.
- Notifications may be delayed or not delivered because of factors outside our control. Do not rely on them alone for urgent or safety-critical matters.
12. Availability, changes and beta features
- We aim to keep the Service available but do not promise that it will be uninterrupted, error free or secure at all times. We may suspend it for maintenance or for reasons outside our control.
- We may add, change or remove features, and we may require you to update the app to keep using it. Features described as beta, preview or early access may be incomplete or change or end without notice.
- We may introduce new features, including paid features, in future. If we introduce fees, we will tell you before you are charged, and the terms for those fees will be added to these Terms or to a separate agreement.
13. Suspension and termination
- You can stop using the Service and delete your account at any time from inside the app. See how to delete your account. Some information may be kept as described in our Privacy Policy, and Organisations may keep the records they are entitled or required to keep.
- We may suspend or end your access, remove content, or close an account, immediately if we reasonably believe that you have breached these Terms, that your use creates risk or harm for others or for us, or that we are required to by law. Where reasonable we will tell you why.
- An Organisation may also remove you or a player from the Organisation.
- Sections that by their nature should continue after termination (including sections 7, 8, 14 to 17, 19 and 20) continue to apply.
14. Disclaimers
- To the maximum extent permitted by law, and subject to section 15, the Service is provided "as is" and "as available". We exclude all warranties, conditions and terms that are not expressly stated in these Terms, whether express, implied, statutory or otherwise, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement.
- We do not warrant that the Service, AI output or any content will be accurate, complete, reliable, current or suitable for your purposes, or that the Service will be free of errors, delays, interruptions or harmful components.
- We are not responsible for the conduct of users or Organisations, or for content posted by them.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that is implied or imposed by law and cannot lawfully be excluded, including the consumer guarantees under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). If you are a consumer, you may have rights that apply despite these Terms.
Where the law allows us to limit our liability for a breach of a guarantee that cannot be excluded, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
16. Limitation of liability
- To the maximum extent permitted by law, and subject to section 15, Eleven2Go and its directors, employees, contractors and licensors are not liable to you for any indirect or consequential loss, or for any loss of profit, revenue, goodwill, opportunity, data or anticipated savings, arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), statute or otherwise, even if we were told it might happen.
- To the maximum extent permitted by law, and subject to section 15, our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose and AUD 100.
- Nothing in these Terms limits liability that cannot be limited by law.
- We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of third-party providers, internet or power failures, natural disasters, industrial action and government action.
17. Indemnity
To the extent permitted by law, you agree to indemnify Eleven2Go and its directors, employees and contractors against any loss, liability, claim, damage or cost (including reasonable legal fees) arising out of your breach of these Terms, Your Content, your misuse of the Service, or your infringement of another person's rights. An Organisation that uses the Service is responsible in the same way for the content it posts and the instructions it gives us, and for claims by its members about how it has used the Service. We will tell you promptly of any claim you are asked to cover and will reasonably cooperate, at your cost.
18. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features or legal requirements. We will post the new version on this page with a new "Last updated" date and, for a material change, give you reasonable notice, such as a message in the app or by email. If you continue to use the Service after the change takes effect, you accept the updated Terms. If you do not agree, you should stop using the Service and delete your account.
19. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia that sit in New South Wales. Before starting formal proceedings, we ask that you contact us so that we can try in good faith to resolve the matter.
20. General
- Entire agreement. These Terms, together with the Privacy Policy and any additional terms we give you for a specific feature, are the entire agreement between you and us about the Service and replace any earlier understanding.
- Severability. If a provision is unenforceable, it will be read down or severed to the minimum extent needed, and the rest of these Terms continue in effect.
- No waiver. If we do not enforce a right, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our written consent. We may assign or transfer our rights and obligations, including in connection with a merger, acquisition or sale of assets, by giving you notice.
- Notices. We may give you notices by posting them in the Service, or by email to the address on your account.
- Relationship. Nothing in these Terms makes you our employee, agent or partner.
- Language. These Terms are written in English. If a translation is provided, the English version prevails if there is any inconsistency.
